Taxation

Compliance, planning, and KRA dispute resolution across Kenya’s evolving tax regime.

1

Overview

Kenya’s tax regime is growing more complex and more actively enforced. Businesses and individuals that do not keep pace with the evolving tax framework face significant exposure, financial, reputational, and operational. At S&P Advocates, we provide practical, expert tax law advice that helps clients meet their obligations confidently, plan their affairs efficiently, and defend their positions effectively when disputes arise.

The Finance Acts of recent years have introduced significant changes to Kenya’s tax regime, including new levies, revised thresholds, expanded withholding obligations, and enhanced KRA enforcement powers. Staying current is not optional. Our team tracks these changes closely and communicates their practical impact to clients in plain, actionable terms.

Do not ignore it and do not respond without legal advice. Contact us immediately. We will review the notice, assess your position, and prepare a structured, well-evidenced response that protects your rights and minimises your exposure from the outset.

You must first file a formal objection with KRA within 30 days of the assessment. If the objection is rejected or not resolved satisfactorily, you can appeal to the Tax Appeals Tribunal. We manage the full objection and appeal process and represent clients at the Tribunal.

Transfer pricing rules apply to transactions between related parties, such as a Kenyan subsidiary and its foreign parent. KRA requires that these transactions be conducted on arm's length terms and properly documented. We advise businesses on transfer pricing compliance and the documentation required.

Yes, in appropriate circumstances. We advise on and negotiate payment arrangements and settlements with KRA where the full liability is not in dispute but immediate payment is not feasible. We represent your interests throughout those negotiations.
